Tips for successful mediation

Despite the reputation for being contentious and hostile, divorce proceedings do not have to be difficult. When both parties agree to mediation in good faith, a settlement agreement may result without litigation.

There are a few things to consider when you are looking to make mediation as successful as possible.

Choose a neutral mediator

Your mediator should have no vested interest in the outcome of your mediation process. He or she should be someone you trust and feel comfortable being open with.

Be open to negotiation

The whole point of mediation is to negotiate your settlement agreement without having to litigate it in court. In order for you to be successful in the process, you must be willing and open to negotiation.

Know your hard limits

When you approach mediation, you should do so with a clear understanding of your hard limits in the settlement. When you identify what is the most important to you in the negotiation, you can be more willingly flexible about other factors that can encourage a settlement agreement.

Keep your emotions out of it

Mediation should be rational, practical and unemotional. Make sure that you approach the process without letting your emotions get the better of you. If you feel emotional, take a break so that you can gather your thoughts and return to the table.

The more you know about how to make mediation successful, the easier the process is. Avoid costly and emotional litigation by working with a mediator to come to your final divorce settlement agreement.
